On December 13, 2016, the 21st Century Cures Act (CURES) was established as a law. According to Section 12006 of the legislation, the Electronic Visit Verification (EVV) System is required for providing personal care services and home health services that come under Medicaid.
This regulation directs states to require the use of Electronic Visit Verification (EVV) for Medicaid-provided personal care services and home health services. It is up to the states to develop their own state-wide implementation model and strategies, administrative structure, eligibility, penalty, and deadlines. Earlier, it was decided that EVV is required to be in place by 2019 for personal care services, and 2023 for home health services. However, the dates may be extended by the states to facilitate implementation and provide sufficient time for agencies to plan.
