The Nebraska Department of Health and Human Services (DHHS) oversees the licensure and practice of various health professions and occupations, including licensing requirements, fees, standards of conduct, practice guidelines, and training standards.

No federal or state regulations require Nebraska employers to provide breaks for their employees. The following federal laws, however, are applicable if the employer has a policy that permits breaks:

• Rest breaks — breaks lasting up to 20 minutes are to be counted into work hours and paid at the regular rate.
• Meal periods — to be unpaid, meal breaks must be at least 30 minutes long, and the employee must be relieved of all duties for their duration.

There is no provision in Nebraska law for the payment of overtime. Only if the employee and employer previously agreed to the overtime pay, can it be claimed under the Nebraska Wage Payment and Collection Act.
