Nebraska's Home Care Regulations & Facts

    Do you know?

Nebraska's DHSS aims to safeguard the state's elderly and disabled adults. Its goal is to standardize statewide minimum requirements and control circumstances through the following rules governing the home care sector:

    • In Nebraska, the average cost of in-home care is $5,148 per month, while home health care costs approximately $5,339.
    • Nebraska's minimum wage rate is $9.00 per hour in 2022, which exceeds the Federal Minimum Wage of $7.25.
    • Nebraska employers must pay their employees all due wages on regularly scheduled paydays. Any changes to the payment schedule must be announced to the employee 30 days in advance.
    • The state has a minimum wage, but there is no provision in Nebraska law for the payment of overtime.
    • Nebraska requires home care aides to undergo a minimum of 75 hours of training, including at least 16 hours of supervised practical training.

Using home care management software can help your business run more smoothly. The GPS-enabled technology can help Nebraska Home Care Agencies function better through accurate billing and payroll, effective time-tracking, and well-regulated training programs.

    FAQs: Home Care in Nebraska

Nebraska is an open-model state, and its EVV implementation deadline was January 01, 2021.

Since Nebraska is an open model state, home care agencies are free to choose any EVV system of their preference, provided it fulfills all the state’s EVV aggregator requirements with NETSMART.

The service authorizations will be sent electronically by Nebraska's DHHS to NETSMART. However, based on those service authorizations, the providers will be in charge of arranging the visits for their members.

CareSmartz360 can be used as an EVV solution in Nebraska. Switching from an old home care software to CareSmartz360 is effortless- all thanks to open APIs, making it an ideal migration tool. These make transition hassle-free and onboarding easy. You can easily connect CareSmartz360 with any existing tool like QuickBooks, Paychex, Waystar, etc.

There are multiple payer options in Nebraska. Some of which are:

    • Private Pay (out of pocket)
    • Medigap Insurance
    • Medicare
    • Medicaid
    • Older Americans Act
    • Veterans Administration
    • Commercial Health Insurance Companies
    • Managed Care Organizations
    • CHAMPUS
    • Workers’ Compensation

The Nebraska Department of Health and Human Services (DHHS) oversees the licensure and practice of various health professions and occupations, including licensing requirements, fees, standards of conduct, practice guidelines, and training standards.

No federal or state regulations require Nebraska employers to provide breaks for their employees. The following federal laws, however, are applicable if the employer has a policy that permits breaks:

    • Rest breaks — breaks lasting up to 20 minutes are to be counted into work hours and paid at the regular rate.
    • Meal periods — to be unpaid, meal breaks must be at least 30 minutes long, and the employee must be relieved of all duties for their duration.

There is no provision in Nebraska law for the payment of overtime. Only if the employee and employer previously agreed to the overtime pay, can it be claimed under the Nebraska Wage Payment and Collection Act.

To help agencies adhere to state EVV regulations, CareSmartz360’s EVV assists businesses in easily monitoring caregiver time with call review, call details, missing clock-in/out, and unidentified calls. You can get a quick look at open shifts and review schedules that have already had billing and payroll finalized.

CareSmartz360's EVV-based solution helps agencies comply with the 21st Century Cures Act. Some ways in which the home care software feature is helpful are:

    • Improved service accountability.
    • Reduced billing errors and claim denial rates.
    • Reduced manual processes and use of paper due to streamlined automation.
    • Streamlined communications between provider offices and caregivers.
    • Service dashboard with reporting capabilities.
    • Search, select, assign and schedule a caregiver easily.
